“Mob Rule Cannot Be Allowed to Override the Decisions of Our Courts”: President Dwight D. Eisenhower"s 1957 Address on Little Rock, Arkansas
In 1954, the Supreme Court unanimously decided in Brown v. Board of Education that public schools segregated according to race were “inherently unequal.” State laws requiring school segregation therefore conflicted with the equal protection clause of the Fourteenth Amendment. The ruling challenged traditional attitudes and threatened a segregated way of life in the South validated in 1896 by the Court’s ruling in Plessyv. Ferguson. The 1896 ruling permitted “separate but equal” public accommodations. In 1955, the Court ordained that desegregation of public schools should proceed “with all deliberate speed;” yet in many parts of the South, reactionary forces resisted. In Little Rock, Arkansas, Governor Orval Faubus challenged efforts by the school board to institute a gradual school desegregation process and ordered state National Guard troops to defy Federal law and stop nine African-American students from attending an all-white high school. As television spread images of the subsequent mob violence around the world, President Dwight D. Eisenhower, in the following radio and television address on September 24, 1957, announced his reluctant response. Despite his disapproval of the Brown decision, Eisenhower, couching his address in the language of law and order, Cold War propaganda, and national pride, became the first president since Reconstruction to send Federal troops to protect the rights of African Americans. Although the nine students enrolled, resistance to desegregation continued as Faubus closed Little Rock high schools the following year and the number of desegregated schools in the South dropped precipitously in the ensuing years.
Good Evening, My Fellow Citizens: For a few minutes this evening I want to speak to you about the serious situation that has arisen in Little Rock. To make this talk I have come to the President’s office in the White House. I could have spoken from Rhode Island, where I have been staying recently, but I felt that, in speaking from the house of Lincoln, of Jackson and of Wilson, my words would better convey both the sadness I feel in the action I was compelled today to take and the firmness with which I intend to pursue this course until the orders of the Federal Court at Little Rock can be executed without unlawful interference.
In that city, under the leadership of demagogic extremists, disorderly mobs have deliberately prevented the carrying out of proper orders from a Federal Court. Local authorities have not eliminated that violent opposition and, under the law, I yesterday issued a Proclamation calling upon the mob to disperse.
This morning the mob again gathered in front of the Central High School of Little Rock, obviously for the purpose of again preventing the carrying out of the Court’s order relating to the admission of Negro children to that school.
Whenever normal agencies prove inadequate to the task and it becomes necessary for the Executive Branch of the Federal Government to use its powers and authority to uphold Federal Courts, the President’s responsibility is inescapable. In accordance with that responsibility, I have today issued an Executive Order directing the use of troops under Federal authority to aid in the execution of Federal law at Little Rock, Arkansas. This became necessary when my Proclamation of yesterday was not observed, and the obstruction of justice still continues.
It is important that the reasons for my action be understood by all our citizens. As you know, the Supreme Court of the United States has decided that separate public educational facilities for the races are inherently unequal and therefore compulsory school segregation laws are unconstitutional.
Our personal opinions about the decision have no bearing on the matter of enforcement; the responsibility and authority of the Supreme Court to interpret the Constitution are very clear. Local Federal Courts were instructed by the Supreme Court to issue such orders and decrees as might be necessary to achieve admission to public schools without regard to race—and with all deliberate speed.
During the past several years, many communities in our Southern States have instituted public school plans for gradual progress in the enrollment and attendance of school children of all races in order to bring themselves into compliance with the law of the land.
They thus demonstrated to the world that we are a nation in which laws, not men, are supreme.
I regret to say that this truth—the cornerstone of our liberties—was not observed in this instance.
It was my hope that this localized situation would be brought under control by city and State authorities. If the use of local police powers had been sufficient, our traditional method of leaving the problems in those hands would have been pursued. But when large gatherings of obstructionists made it impossible for the decrees of the Court to be carried out, both the law and the national interest demanded that the President take action.
Here is the sequence of events in the development of the Little Rock school case.
In May of 1955, the Little Rock School Board approved a moderate plan for the gradual desegregation of the public schools in that city. It provided that a start toward integration would be made at the present term in the high school, and that the plan would be in full operation by 1963. Here I might say that in a number of communities in Arkansas integration in the schools has already started and without violence of any kind. Now this Little Rock plan was challenged in the courts by some who believed that the period of time as proposed in the plan was too long.
The United States Court at Little Rock, which has supervisory responsibility under the law for the plan of desegregation in the public schools, dismissed the challenge, thus approving a gradual rather than an abrupt change from the existing system. The court found that the school board had acted in good faith in planning for a public school system free from racial discrimination.
Since that time, the court has on three separate occasions issued orders directing that the plan be carried out. All persons were instructed to refrain from interfering with the efforts of the school board to comply with the law.
Proper and sensible observance of the law then demanded the respectful obedience which the nation has a right to expect from all its people. This, unfortunately, has not been the case at Little Rock. Certain misguided persons, many of them imported into Little Rock by agitators, have insisted upon defying the law and have sought to bring it into disrepute. The orders of the court have thus been frustrated.
The very basis of our individual rights and freedoms rests upon the certainty that the President and the Executive Branch of Government will support and insure the carrying out of the decisions of the Federal Courts, even, when necessary with all the means at the President’s command.
Unless the President did so, anarchy would result.
There would be no security for any except that which each one of us could provide for himself.
The interest of the nation in the proper fulfillment of the law’s requirements cannot yield to opposition and demonstrations by some few persons.
Mob rule cannot be allowed to override the decisions of our courts.
Now, let me make it very clear that Federal troops are not being used to relieve local and state authorities of their primary duty to preserve the peace and order of the community. Nor are the troops there for the purpose of taking over the responsibility of the School Board and the other responsible local officials in running Central High School. The running of our school system and the maintenance of peace and order in each of our States are strictly local affairs and the Federal Government does not interfere except in a very few special cases and when requested by one of the several States. In the present case the troops are there, pursuant to law, solely for the purpose of preventing interference with the orders of the Court.
The proper use of the powers of the Executive Branch to enforce the orders of a Federal Court is limited to extraordinary and compelling circumstances. Manifestly, such an extreme situation has been created in Little Rock. This challenge must be met and with such measures as will preserve to the people as a whole their lawfully-protected rights in a climate permitting their free and fair exercise. The overwhelming majority of our people in every section of the country are united in their respect for observance of the law—even in those cases where they may disagree with that law.
They deplore the call of extremists to violence.
The decision of the Supreme Court concerning school integration, of course, affects the South more seriously than it does other sections of the country. In that region I have many warm friends, some of them in the city of Little Rock. I have deemed it a great personal privilege to spend in our Southland tours of duty while in the military service and enjoyable recreational periods since that time.
So from intimate personal knowledge, I know that the overwhelming majority of the people in the South—including those of Arkansas and of Little Rock—are of good will, united in their efforts to preserve and respect the law even when they disagree with it.
They do not sympathize with mob rule. They, like the rest of our nation, have proved in two great wars their readiness to sacrifice for America.
A foundation of our American way of life is our national respect for law.
In the South, as elsewhere, citizens are keenly aware of the tremendous disservice that has been done to the people of Arkansas in the eyes of the nation, and that has been done to the nation in the eyes of the world.
At a time when we face grave situations abroad because of the hatred that Communism bears toward a system of government based on human rights, it would be difficult to exaggerate the harm that is being done to the prestige and influence, and indeed to the safety, of our nation and the world.
Our enemies are gloating over this incident and using it everywhere to misrepresent our whole nation. We are portrayed as a violator of those standards of conduct which the peoples of the world united to proclaim in the Charter of the United Nations. There they affirmed “faith in fundamental human rights” and “in the dignity and worth of the human person” and they did so “without distinction as to race, sex, language or religion.”
And so, with deep confidence, I call upon the citizens of the State of Arkansas to assist in bringing to an immediate end all interference with the law and its processes. If resistance to the Federal Court orders ceases at once, the further presence of Federal troops will be unnecessary and the City of Little Rock will return to its normal habits of peace and order and a blot upon the fair name and high honor of our nation in the world will be removed.
Thus will be restored the image of America and of all its parts as one nation, indivisible, with liberty and justice for all.

Today, Switzerland convened a conference of State Parties to the Fourth Geneva Convention, to discuss the law of occupation as it pertains to Israel. There have been just a couple of previous occasions when Geneva convened the signatories of its eponymous treaty, and every single one has beenabout Israel. (Jerusalem, Washington, Ottawa, and Canberra have announced they will snub the confab.)
Yet there is nothing wrong with an international conference to discuss the Fourth Geneva Convention, and to attempt to better understand its requirements as they apply in particular situations. Art. 49(6)’s prohibition of “deportation and transfer” into occupied territory could certainly do with elucidation. (The “deport or transfer” ban is commonly referred to as “settlement building.”)
Indeed, an examination of movement into occupied territory in Georgia, Ukraine, Azerbaijan, Western Sahara, and Cyprus would be both timely and instructive. Needless to say, this is not what the state parties will be discussing. They are, sadly, not interested in the Geneva Conventions, but only their possible use against Israel. But if the State Parties were to want an interesting agenda, here are some questions they might ask.
1. The first relates to the ICRC’s own definition of occupation (a precondition to the applicability of the “deport or transfer” norm). The state parties apparently regard Israel as occupying Gaza, to say nothing of all of the West Bank, despite the removal of Israeli troops from those areas and the existence of an independent Palestinian administration there. However, occupation in all other contexts requires the occupying power to displace and actually function as the governing authority, conditions that do not apply in Gaza and large parts of the West Bank (Area A).
Occupation ceases when the occupying forces are driven out of or evacuate the territory. (emphasis in the original)
How Israel’s occupation squares with the ICRC’s own definition of the term would be a useful subject for the state parties.
2. Also on the subject of the existence of occupation, it is curious why no one ever discusses Cession of Vessels and Tugs for Navigation on the Danube, a decision cited not infrequently for other propositions, but also directly relevant to the existence of a belligerent occupation. (The 1921 international law case was interpreting The Hague Convention’s provisions on the scope of occupation, but the Geneva Conventions preserve those rules.) The arbitrators ruled that the military seizure of territory that was not, at the time, under any sovereignty (because of the collapse of the Austro-Hungarian empire) did not amount to occupation within the meaning of the Hague Conventions. It would be nice to know why the State Parties think the decision is so obviously wrong or irrelevant that no one even bothers to distinguish it away in discussions of “The Occupation.”
Then there are some fun puzzlers about “settlements.” If it is true that the Geneva Convention’s provisions on occupation apply to all territory taken in war, regardless of prior sovereign status, several interesting anomalies arise. (This is just a small sampling of paradoxes, inconsistencies and incoherences that arise when attempting to apply the “rules” of Geneva.)
3. Both North and South Korea should be seen as guilty of conquest and settlements, as both took territory on the other side of the 38th parallel at the conclusion of the Korean War. This territory was not previously under their control, and the international community does not recognize either Korea as the legitimate sovereign of the entire peninsula, which they both claim. Thus the North Korean presence south the 38th parallel should be an “occupation,” and vice versa. For example, the city of Kaesong was seized by the North and remained in its hands under the armistice agreement. Yet no one seems to regard this as occupation, or construction there as settlement building.
4. The U.S. and most other countries do not recognize Israeli sovereignty over even western Jerusalem, which came under Israeli control in the 1948-49 War of Independence, or al-Nakba (The Catastrophe). Indeed, at oral arguments in Zivotofsky v. Kerry, the Jerusalem Passport case, the Solicitor General compared Israel’s position in western Jerusalem to that of Russia’s in Crimea and eastern Ukraine. (So Putin was not the first tocompare Crimea to Jerusalem.)
Of course, Crimea is under belligerent occupation. This means that all construction and migration in Western Jerusalem should be, by the definition of these terms often applied to eastern Jerusalem, illegal settlement activity. Of course, no one has ever regarded it as such, illustrating the incoherence of the formulation of the norm.
5. A recent Reuters story highlighted how Israeli Arabs are moving “across the Green Line” into homes in eastern Jerusalem. The prohibition on “settlers” applies to the entire “civilian population” of the occupier, and makes no exceptions based ethnicity. Yet in the context of Israel,“settlement activity” by Israelis of non-Jewish ethnicity does not meet with international condemnation. Conversely, the movement of new immigrants from third-countries does meet with accusations of illegality in the Israeli context, even though they do not seem to be part of the relevant “civilian population.” A further clarification of this issue would be very helpful to understand a variety of settlement related questions that no one is asking, from Russian liability for settlements in Georgia, to whether British and other European residents of Northern Cyprus can be considered “illegal settlers.”
A key virtue of a legal system is the consistency or coherence of its rules across multiple disparate cases. Special pleading, invocations of sui generis status, and so forth, make the law less law like. With that in mind, I will be happy to hear solutions to these riddles, ideally ones that do not fall back on the “spirit” of the Geneva Conventions.

There was an artist in the city of Kouroo who was disposed to strive after perfection. One day it came into his mind to make a staff. Having considered that in an imperfect work time is an ingredient, but into a perfect work time does not enter, he said to himself, It shall be perfect in all respects, though I should do nothing else in my life. He proceeded instantly to the forest for wood, being resolved that it should not be made of unsuitable material; and as he searched for and rejected stick after stick, his friends gradually deserted him, for they grew old in their works and died, but he grew not older by a moment. His singleness of purpose and resolution, and his elevated piety, endowed him, without his knowledge, with perennial youth. As he made no compromise with Time, Time kept out of his way, and only sighed at a distance because he could not overcome him. But why do I stay to mention these things? When the finishing stroke was put to his work, it suddenly expanded before the eyes of the astonished artist into the fairest of all the creations of Brahma. He had made a new system in making a staff, a world with full and fair proportions; in which, though the old cities and dynasties had passed away, fairer and more glorious ones had taken their places. And now he saw by the heap of shavings still fresh at his feet, that, for him and his work, the former lapse of time had been an illusion, and that no more time had elapsed than is required for a single scintillation from the brain of Brahma to fall on and inflame the tinder of a mortal brain. The material was pure, and his art was pure; how could the result be other than wonderful?
During the Gaza war this summer, it became clear that one of the most important aspects of the media-saturated conflict between Jews and Arabs is also the least covered: the press itself. The Western press has become less an observer of this conflict than an actor in it, a role with consequences for the millions of people trying to comprehend current events, including policymakers who depend on journalistic accounts to understand a region where they consistently seek, and fail, to productively intervene.
An essay I wrote for Tablet on this topic in the aftermath of the war sparked intense interest. In the article, based on my experiences between 2006 and 2011 as a reporter and editor in the Jerusalem bureau of the Associated Press, one of the world’s largest news organizations, I pointed out the existence of a problem and discussed it in broad terms. Using staffing numbers, I illustrated the disproportionate media attention devoted to this conflict relative to other stories, and gave examples of editorial decisions that appeared to be driven by ideological considerations rather than journalistic ones. I suggested that the cumulative effect has been to create a grossly oversimplified story—a kind of modern morality play in which the Jews of Israel are displayed more than any other people on earth as examples of moral failure. This is a thought pattern with deep roots in Western civilization.
But how precisely does this thought pattern manifest itself in the day-to-day functioning, or malfunctioning, of the press corps? To answer this question, I want to explore the way Western press coverage is shaped by unique circumstances here in Israel and also by flaws affecting the media beyond the confines of this conflict. In doing so, I will draw on my own experiences and those of colleagues. These are obviously limited and yet, I believe, representative.
I’ll begin with a simple illustration. The above photograph is of a student rally held last November at Al-Quds University, a mainstream Palestinian institution in East Jerusalem. The rally, in support of the armed fundamentalist group Islamic Jihad, featured actors playing dead Israeli soldiers and a row of masked men whose stiff-armed salute was returned by some of the hundreds of students in attendance. Similar rallies have been held periodically at the school.
I am not using this photograph to make the case that Palestinians are Nazis. Palestinians are not Nazis. They are, like Israelis, human beings dealing with a difficult present and past in ways that are occasionally ugly. I cite it now for a different reason.
Such an event at an institution like Al-Quds University, headed at the time by a well-known moderate professor, and with ties to sister institutions in America, indicates something about the winds now blowing in Palestinian society and across the Arab world. The rally is interesting for the visual connection it makes between radical Islam here and elsewhere in the region; a picture like this could help explain why many perfectly rational Israelis fear withdrawing their military from East Jerusalem or the West Bank, even if they loathe the occupation and wish to live in peace with their Palestinian neighbors. The images from the demonstration were, as photo editors like to say, “strong.” The rally had, in other words, all the necessary elements of a powerful news story.
The event took place a short drive from the homes and offices of the hundreds of international journalists who are based in Jerusalem. Journalists were aware of it: The sizable Jerusalem bureau of the Associated Press, for example, which can produce several stories on an average day, was in possession of photos of the event, including the one above, a day later. (The photographs were taken by someone I know who was on campus that day, and I sent them to the bureau myself.) Jerusalem editors decided that the images, and the rally, were not newsworthy, and the demonstration was only mentioned by the AP weeks later when the organization’s Boston bureau reported that Brandeis University had cut ties with Al-Quds over the incident. On the day that the AP decided to ignore the rally, November 6, 2013, the same bureau published a report about a pledge from the U.S. State Department to provide a minor funding increase for the Palestinian Authority; that was newsworthy. This is standard. To offer another illustration, the construction of 100 apartments in a Jewish settlement is always news; the smuggling of 100 rockets into Gaza by Hamas is, with rare exceptions, not news at all.
I mention these instances to demonstrate the kind of decisions made regularly in the bureaus of the foreign press covering Israel and the Palestinian territories, and to show the way in which the pipeline of information from this place is not just rusty and leaking, which is the usual state of affairs in the media, but intentionally plugged.
There are banal explanations for problems with coverage—reporters are in a hurry, editors are overloaded and distracted. These are realities, and can explain small errors and mishaps like ill-conceivedheadlines, which is why such details don’t typically strike me as important or worth much analysis. Some say inflations and omissions are the inevitable results of an honest attempt to cover events in a challenging and occasionally dangerous reporting environment, which is what I initially believed myself. A few years on the job changed my mind. Such excuses can’t explain why the same inflations and omissions recur again and again, why they are common to so many news outlets, and why the simple “Israel story” of the international media is so foreign to people aware of the historical and regional context of events in this place. The explanation lies elsewhere.

To make sense of most international journalism from Israel, it is important first to understand that the news tells us far less about Israel than about the people writing the news. Journalistic decisions are made by people who exist in a particular social milieu, one which, like most social groups, involves a certain uniformity of attitude, behavior, and even dress (the fashion these days, for those interested, is less vests with unnecessary pockets than shirts with unnecessary buttons). These people know each other, meet regularly, exchange information, and closely watch one another’s work. This helps explain why a reader looking at articles written by the half-dozen biggest news providers in the region on a particular day will find that though the pieces are composed and edited by completely different people and organizations, they tend to tell the same story.
The best insight into one of the key phenomena at play here comes not from a local reporter but from the journalist and author Philip Gourevitch. In Rwanda and elsewhere in Africa, Gourevitch wrote in 2010, he was struck by the ethical gray zone of ties between reporters and NGOs. “Too often the press represents humanitarians with unquestioning admiration,” he observed in The New Yorker. “Why not seek to keep them honest? Why should our coverage of them look so much like their own self-representation in fund-raising appeals? Why should we (as many photojournalists and print reporters do) work for humanitarian agencies between journalism jobs, helping them with their official reports and institutional appeals, in a way that we would never consider doing for corporations, political parties, or government agencies?”
This confusion is very much present in Israel and the Palestinian territories, where foreign activists are a notable feature of the landscape, and where international NGOs and numerous arms of the United Nations are among the most powerful players, wielding billions of dollars and employing many thousands of foreign and local employees. Their SUVs dominate sections of East Jerusalem and their expense accounts keep Ramallah afloat. They provide reporters with social circles, romantic partners, and alternative employment—a fact that is more important to reporters now than it has ever been, given the disintegration of many newspapers and the shoestring nature of their Internet successors.
In my time in the press corps, I learned that our relationship with these groups was not journalistic. My colleagues and I did not, that is, seek to analyze or criticize them. For many foreign journalists, these were not targets but sources and friends—fellow members, in a sense, of an informal alliance. This alliance consists of activists and international staffers from the UN and the NGOs; the Western diplomatic corps, particularly in East Jerusalem; and foreign reporters. (There is also a local component, consisting of a small number of Israeli human-rights activists who are themselves largely funded by European governments, and Palestinian staffers from the Palestinian Authority, the NGOs, and the UN.) Mingling occurs at places like the lovely Oriental courtyard of the American Colony hotel in East Jerusalem, or at parties held at the British Consulate’s rooftop pool. The dominant characteristic of nearly all of these people is their transience. They arrive from somewhere, spend a while living in a peculiar subculture of expatriates, and then move on.
In these circles, in my experience, a distaste for Israel has come to be something between an acceptable prejudice and a prerequisite for entry. I don’t mean a critical approach to Israeli policies or to the ham-fisted government currently in charge in this country, but a belief that to some extent the Jews of Israel are a symbol of the world’s ills, particularly those connected to nationalism, militarism, colonialism, and racism—an idea quickly becoming one of the central elements of the “progressive” Western zeitgeist, spreading from the European left to American college campuses and intellectuals, including journalists. In this social group, this sentiment is translated into editorial decisions made by individual reporters and editors covering Israel, and this, in turn, gives such thinking the means of mass self-replication.

Anyone who has traveled abroad understands that arriving in a new country is daunting, and it is far more so when you are expected to show immediate expertise. I experienced this myself in 2008, when the AP sent me to cover the Russian invasion of Georgia and I found myself 24 hours later riding in a convoy of Russian military vehicles. I had to admit that not only did I not know Georgian, Russian, or any of the relevant history, but I did not know which way was north, and generally had no business being there. For a reporter in a situation like the one I just described, the solution is to stay close to more knowledgeable colleagues and hew to the common wisdom.
Many freshly arrived reporters in Israel, similarly adrift in a new country, undergo a rapid socialization in the circles I mentioned. This provides them not only with sources and friendships but with a ready-made framework for their reporting—the tools to distill and warp complex events into a simple narrative in which there is a bad guy who doesn’t want peace and a good guy who does. This is the “Israel story,” and it has the advantage of being an easy story to report. Everyone here answers their cell phone, and everyone knows what to say. You can put your kids in good schools and dine at good restaurants. It’s fine if you’re gay. Your chances of being beheaded on YouTube are slim. Nearly all of the information you need—that is, in most cases, information critical of Israel—is not only easily accessible but has already been reported for you by Israeli journalists or compiled by NGOs. You can claim to be speaking truth to power, having selected the only “power” in the area that poses no threat to your safety.
Many foreign journalists have come to see themselves as part of this world of international organizations, and specifically as the media arm of this world. They have decided not just to describe and explain, which is hard enough, and important enough, but to “help.” And that’s where reporters get into trouble, because “helping” is always a murky, subjective, and political enterprise, made more difficult if you are unfamiliar with the relevant languages and history.
Confusion over the role of the press explains one of the strangest aspects of coverage here—namely, that while international organizations are among the most powerful actors in the Israel story, they are almost never reported on. Are they bloated, ineffective, or corrupt? Are they helping, or hurting? We don’t know, because these groups are to be quoted, not covered. Journalists cross from places like the BBC to organizations like Oxfam and back. The current spokesman at the UN agency for Palestinian refugees in Gaza, for example, is a former BBC man. A Palestinian woman who participated in protests against Israel and tweeted furiously about Israel a few years ago served at the same time as a spokesperson for a UN office, and was close friends with a few reporters I know. And so forth.
International organizations in the Palestinian territories have largely assumed a role of advocacy on behalf of the Palestinians and against Israel, and much of the press has allowed this political role to supplant its journalistic function. This dynamic explains the thinking behind editorial choices that are otherwise difficult to grasp, like the example I gave in my first essay about the suppressionby the AP’s Jerusalem bureau of a report about an Israeli peace offer to the Palestinians in 2008, or the decision to ignore the rally at Al-Quds University, or the idea that Hamas’s development of extensive armament works in Gaza in recent years was not worth serious coverage despite objectively being one of the most important storylines demanding reporters’ attention.
As usual, Orwell got there first. Here is his description from 1946 of writers of communist and “fellow-traveler” journalism: “The argument that to tell the truth would be ‘inopportune’ or would ‘play into the hands of’ somebody or other is felt to be unanswerable, and few people are bothered by the prospect that the lies which they condone will get out of the newspapers and into the history books.” The stories I mentioned would be “inopportune” for the Palestinians, and would “play into the hands” of the Israelis. And so, in the judgment of the press corps, they generally aren’t news.
In the aftermath of the three-week Gaza war of 2008-2009, not yet quite understanding the way things work, I spent a week or so writing a story about NGOs like Human Rights Watch, whose work on Israel had just been subject to an unusual public lashing in The New York Times by its own founder, Robert Bernstein. (The Middle East, he wrote, “is populated by authoritarian regimes with appalling human rights records. Yet in recent years Human Rights Watch has written far more condemnations of Israel for violations of international law than of any other country in the region.”) My article was gentle, all things considered, beginning like this:
JERUSALEM (AP) _ The prickly relationship between Israel and its critics in human rights organizations has escalated into an unprecedented war of words as the fallout from Israel’s Gaza offensive persists ten months after the fighting ended.
Editors killed the story.
Around this time, a Jerusalem-based group called NGO Monitor was battling the international organizations condemning Israel after the Gaza conflict, and though the group was very much a pro-Israel outfit and by no means an objective observer, it could have offered some partisan counterpoint in our articles to charges by NGOs that Israel had committed “war crimes.” But the bureau’s explicit orders to reporters were to never quote the group or its director, an American-raised professor named Gerald Steinberg.* In my time as an AP writer moving through the local conflict, with its myriad lunatics, bigots, and killers, the only person I ever saw subjected to an interview ban was this professor.
When the UN released its controversial Goldstone report on the Gaza fighting, we at the bureau trumpeted its findings in dozens of articles, though there was discussion even at the time of the report’s failure to prove its central charge: that Israel had killed civilians on purpose. (The director of Israel’s premier human-rights group, B’Tselem, who was critical of the Israeli operation, told me at the time that this claim was “a reach given the facts,” an evaluation that was eventually seconded by the report’s author. “If I had known then what I know now, the Goldstone Report would have been a different document,” Richard Goldstone wrote in The Washington Post in April 2011.) We understood that our job was not to look critically at the UN report, or any such document, but to publicize it.
Decisions like these are hard to fathom if you believe the foreign press corps’ role is to explain a complicated story to people far away. But they make sense if you understand that journalists covering Israel and the Palestinian territories often don’t see their role that way. The radio and print journalist Mark Lavie, who has reported from the region since 1972, was a colleague of mine at the AP, where he was an editor in the Jerusalem bureau and then in Cairo until his retirement last year. (It was Lavie who first learned of the Israeli peace offer of late 2008, and was ordered by his superiors to ignore the story.) An Indiana-born Israeli of moderate politics, he had a long run in journalism that included several wars and the first Palestinian intifada, and found little reason to complain about the functioning of the media.
But things changed in earnest in 2000, with the collapse of peace efforts and the outbreak of the Second Intifada. Israel accepted President Bill Clinton’s peace framework that fall and the Palestinians rejected it, as Clinton made clear. Nevertheless, Lavie recently told me, the bureau’s editorial line was still that the conflict was Israel’s fault, and the Palestinians and the Arab world were blameless. By the end of Lavie’s career, he was editing Israel copy on the AP’s Middle East regional desk in Cairo, trying to restore balance and context to stories he thought had little connection to reality. In his words, he had gone from seeing himself as a proud member of the international press corps to “the Jew-boy with his finger in the dike.” He wrote a book, Broken Spring, about his front-row view of the Middle East’s descent into chaos, and retired disillusioned and angry.
I have tended to see the specific failings that we both encountered at the AP as symptoms of a general thought pattern in the press, but Lavie takes a more forceful position, viewing the influential American news organization as one of the primary authors of this thought pattern. (In a statement, AP spokesman Paul Colford dismissed my criticism as “distortions, half-truths and inaccuracies,” and denied that AP coverage is biased against Israel.) This is not just because many thousands of media outlets use AP material directly, but also because when journalists arrive in their offices in the morning, the first thing many of them do is check the AP wire (or, these days, scroll through it in their Twitter feed). The AP is like Ringo Starr, thumping away at the back of the stage: there might be flashier performers in front, and you might not always notice him, but when Ringo’s off, everyone’s off.
Lavie believes that in the last years of his career, the AP’s Israel operation drifted from its traditional role of careful explanation toward a kind of political activism that both contributed to and fed off growing hostility to Israel worldwide. “The AP is extremely important, and when the AP turned, it turned a lot of the world with it,” Lavie said. “That’s when it became harder for any professional journalist to work here, Jewish or not. I reject the idea that my dissatisfaction had to do with being Jewish or Israeli. It had to do with being a journalist.”

In describing the realities of combat in the Second World War, the American critic Paul Fussell wrote, the press was censored and censored itself to such an extent that “for almost six years a large slice of actuality—perhaps one-quarter to one-half of it—was declared off-limits, and the sanitized and euphemized remainder was presented as the whole.” During the same war, American journalists (chiefly from Henry Luce’s magazines) were engaged in what Fussell called the “Great China Hoax”—years of skewed reporting designed to portray the venal regime of Chiang Kai-shek as an admirable Western ally against Japan. Chiang was featured six times on the cover of Time, and his government’s corruption and dysfunction were carefully ignored. One Marine stationed in China was so disillusioned by the chasm between what he saw and what he read that upon his discharge, he said, “I switched to Newsweek.”
Journalistic hallucinations, in other words, have a precedent. They tend to occur, as in the case of the Great China Hoax, when reporters are not granted the freedom to write what they see but are rather expected to maintain a “story” that follows predictable lines. For the international press, the uglier characteristics of Palestinian politics and society are mostly untouchable because they would disrupt the Israel story, which is a story of Jewish moral failure.
Most consumers of the Israel story don’t understand how the story is manufactured. But Hamas does. Since assuming power in Gaza in 2007, the Islamic Resistance Movement has come to understand that many reporters are committed to a narrative wherein Israelis are oppressors and Palestinians passive victims with reasonable goals, and are uninterested in contradictory information. Recognizing this, certain Hamas spokesmen have taken to confiding to Western journalists, including some I know personally, that the group is in fact a secretly pragmatic outfit with bellicose rhetoric, and journalists—eager to believe the confession, and sometimes unwilling to credit locals with the smarts necessary to deceive them—have taken it as a scoop instead of as spin.
During my time at the AP, we helped Hamas get this point across with a school of reporting that might be classified as “Surprising Signs of Moderation” (a direct precursor to the “Muslim Brotherhood Is Actually Liberal” school that enjoyed a brief vogue in Egypt). In one of my favorite stories, “More Tolerant Hamas” (December 11, 2011), reporters quoted a Hamas spokesman informing readers that the movement’s policy was that “we are not going to dictate anything to anyone,” and another Hamas leader saying the movement had “learned it needs to be more tolerant of others.” Around the same time, I was informed by the bureau’s senior editors that our Palestinian reporter in Gaza couldn’t possibly provide critical coverage of Hamas because doing so would put him in danger.
Hamas is aided in its manipulation of the media by the old reportorial belief, a kind of reflex, according to which reporters shouldn’t mention the existence of reporters. In a conflict like ours, this ends up requiring considerable exertions: So many photographers cover protests in Israel and the Palestinian territories, for example, that one of the challenges for anyone taking pictures is keeping colleagues out of the frame. That the other photographers are as important to the story as Palestinian protesters or Israeli soldiers—this does not seem to be considered.
In Gaza, this goes from being a curious detail of press psychology to a major deficiency. Hamas’s strategy is to provoke a response from Israel by attacking from behind the cover of Palestinian civilians, thus drawing Israeli strikes that kill those civilians, and then to have the casualties filmed by one of the world’s largest press contingents, with the understanding that the resulting outrage abroad will blunt Israel’s response. This is a ruthless strategy, and an effective one. It is predicated on the cooperation of journalists. One of the reasons it works is because of the reflex I mentioned. If you report that Hamas has a strategy based on co-opting the media, this raises several difficult questions, like, What exactly is the relationship between the media and Hamas? And has this relationship corrupted the media? It is easier just to leave the other photographers out of the frame and let the picture tell the story: Here are dead people, and Israel killed them.
In previous rounds of Gaza fighting, Hamas learned that international coverage from the territory could be molded to its needs, a lesson it would implement in this summer’s war. Most of the press work in Gaza is done by local fixers, translators, and reporters, people who would understandably not dare cross Hamas, making it only rarely necessary for the group to threaten a Westerner. The organization’s armed forces could be made to disappear. The press could be trusted to play its role in the Hamas script, instead of reporting that there was such a script. Hamas strategy did not exist, according to Hamas—or, as reporters would say, was “not the story.” There was no Hamas charter blaming Jews for centuries of perfidy, or calling for their murder; this was not the story. The rockets falling on Israeli cities were quite harmless; they were not the story either.
Hamas understood that journalists would not only accept as fact the Hamas-reported civilian death toll—relayed through the UN or through something called the “Gaza Health Ministry,” an office controlled by Hamas—but would make those numbers the center of coverage. Hamas understood that reporters could be intimidated when necessary and that they would not report the intimidation; Western news organizations tend to see no ethical imperative to inform readers of the restrictions shaping their coverage in repressive states or other dangerous areas. In the war’s aftermath, the NGO-UN-media alliance could be depended upon to unleash the organs of the international community on Israel, and to leave the jihadist group alone.
When Hamas’s leaders surveyed their assets before this summer’s round of fighting, they knew that among those assets was the international press. The AP staff in Gaza City would witness a rocket launch right beside their office, endangering reporters and other civilians nearby—and the AP wouldn’t report it, not even in AP articles about Israeli claims that Hamas was launching rockets from residential areas. (This happened.) Hamas fighters would burst into the AP’s Gaza bureau and threaten the staff—and the AP wouldn’t report it. (This also happened.) Cameramen waiting outside Shifa Hospital in Gaza City would film the arrival of civilian casualties and then, at a signal from an official, turn off their cameras when wounded and dead fighters came in, helping Hamas maintain the illusion that only civilians were dying. (This too happened; the information comes from multiple sources with firsthand knowledge of these incidents.)
Colford, the AP spokesman, confirmed that armed militants entered the AP’s Gaza office in the early days of the war to complain about a photo showing the location of a rocket launch, though he said that Hamas claimed that the men “did not represent the group.” The AP “does not report many interactions with militias, armies, thugs or governments,” he wrote. “These incidents are part of the challenge of getting out the news—and not themselves news.”
This summer, with Yazidis, Christians, and Kurds falling back before the forces of radical Islam not far away from here, this ideology’s local franchise launched its latest war against the last thriving minority in the Middle East. The Western press corps showed up en masse to cover it. This conflict included rocket barrages across Israel and was deliberately fought from behind Palestinian civilians, many of whom died as a result. Dulled by years of the “Israel story” and inured to its routine omissions, confused about the role they are meant to play, and co-opted by Hamas, reporters described this war as an Israeli onslaught against innocent people. By doing so, this group of intelligent and generally well-meaning professionals ceased to be reliable observers and became instead an amplifier for the propaganda of one of the most intolerant and aggressive forces on earth. And that, as they say, is the story.

Mainstream Western media coverage of Israel is laced with expressions intentionally crafted to delegitimize the Jewish State. The good news is that these terms weren’t written in stone 3,300 years ago, but are post-Israel independence creations. By using this language, we forfeit our history. Here are 13 phrases we must stop repeating.
#1 – “West Bank:”Claims that “Judea and Samaria” is simply the “biblical name for the West Bank” stands history on its head. The Hebrew-origin terms “Judea” and “Samaria” were used through 1950, when invading [Trans]Jordan renamed them the “West Bank” in order to disassociate these areas of the Jewish homeland from Jews. The UN’s own 1947 partition resolution referred not to “West Bank,” but to “the hill country of Samaria and Judea.” This term is not shorthand for “Judea and Samaria.” Under this formulation, Jordan is the “East Bank” of the original Palestine Mandate, which was designated as the homeland for the Jewish People.
Jerusalem – the eternal, united capital of the Jewish nation.
#2 – “East” Jerusalem or “traditionally Arab East” Jerusalem:From the city’s second millennium BCE origins until 1947 CE, there was no such place as “East” Jerusalem. The 19 years between when invading Jordan captured part of the city in 1948 and was ousted by Israel in 1967 was the only time in history, except between 638 and 1099, when Arabs ruled any part of Jerusalem. Palestinian Arabs have not ruled an inch of it for one day in history. In the past three millennia, Jerusalem has been the capital of three native states – Judah, Judaea, and modern Israel – and has had a renewed Jewish majority since 19thcentury Turkish rule. Eastern Jerusalem is a neighborhood of the city that Israel reunified in 1967.
#3 – “The UN sought to create Jewish and Palestinian States:”It did not. Partitioning Palestine between “Palestinians” and Jews is like partitioning Pennsylvania between Pennsylvanians and Jews. Over and over in its 1947 partition resolution, the UN referenced “the Jewish State” and “the Arab” [not “Palestinian”] State.
#4 – 1948 was the “Creation” and “Founding” of Israel:Israel wasn’t “created” and “founded” in 1948 artificially and out-of-the-blue. Israel attained independence that year as the natural fruition into renewed statehood of a people that had twice before been independent in that land, and after centuries of hard work to re-establish a Jewish State in this historic homeland.
#5 – “The War that Followed Israel’s Creation:”Israeli did not choose this war; it was hoisted on Israel by almost every Arab state, which rejected the UN partition and tried to push the Jews of Israel into the sea. And it was a homeland Jewish army, Haganah, which became the IDF, that threw back that multi-nation foreign invasion.
#6– “Palestinian Refugees of the War that Followed Israel’s Creation,” or the “Palestinian Refugee Issue:”It was the invading Arab nations bent on Israel’s destruction that both encouraged and caused the bulk of the Arabs to flee Israel. And a greater number of media constantly ignore the indigenous Middle Eastern Jews who were expelled from vast Arab and other Muslim lands in the wake of the Arab-Israeli War. Their number is greater than the amount of Arabs that fled tiny Israel. That Israel absorbed the bulk of these Jews, while Arab “hosts,”including in Palestine itself, isolate the Arab refugees’ descendants in Western-supported “refugee camps” does not convert the Arab-Israeli conflict’s two-sided refugee issue into a “Palestinian” refugee issue. Had the Palestinian Arabs accepted the UN partition plan, they would also have been celebrating their 66th anniversary.

#7 – Israel “Seized”Arab Lands in 1967:It did not. The 1967 war, like its predecessors, was a defensive war forced upon Israel. Israel’s neighbors did not want to compromise; they simply wanted to destroy the Jewish State. The new Israeli territory was meant to provide a security barrier and ensure this could never happen. Moreover, these were not “Arab Lands.”
#8 – Israel’s “1967 Borders:”The 1949 Israel-Jordan Armistice Agreement expressly declared the “green line” it drew between the two sides’ ceasefire positions as a military ceasefire line only, without prejudice to either side’s political border claims.The post-’67 war UN resolution 242 pointedly did not demand Israel retreat from these lines.
#9 – “Israeli-Occupied West Bank and East Jerusalem:”That the media insistently calls Israeli presence in the heart of Jerusalem and in Judea and Samaria “Israeli occupation of Palestinian territories” does not make it so. “Occupation” is an international law term referencing foreign presence in the sovereign territory of another state. The land of Israel’s last sovereign native state before modern Israel was Jewish Judaea. The land ratio of Arab lands to Israel is 625-1, 23 states to one.
#10 – “Jewish Settlers and Settlements” vs. “Palestinian Residents of Neighborhoods and Villages:”A favorite media news article contrast is referencing in the same sentence “Jewish settlers” in “settlements” and “Palestinian residents” of nearby “neighborhoods” and “villages.” Jews are not alien“ settlers” in a Jerusalem that’s had a Jewish majority since 19th century times or in the Judea-Samaria Jewish historical heartland.
#11 – Israel’s “Jewish State” recognition is “a new stumbling block”:New since Moses’ time. The Jewish homeland of Israel, including continuous homeland-claiming Jewish presence, has always been central to Jewish peoplehood. In 1947, British Foreign Secretary Bevin told Parliament that the Jews’ “essential point of principle” was Jewish Palestine sovereignty.

#12 – “Palestinians accept and Israel rejects a Two-State Solution:”Wrong on both counts. Both the U.S. and Israel define ‘Two States’ as two states for two peoples – Jews and Arabs. Many on the Arab side insistently rejects two states for two peoples. Many Israelis, including Prime Minister Netanyahu, support that plan – conditioned on an end to Palestinian terror. The Arabs continuously and consistently deny Israel’s right to exist as the nation-state of the Jewish People, no matter where its borders are drawn.
#13 – “The Palestinians:”The United Nations’ 1947 partition resolution called Palestine’s Arabs and Jews “the two Palestinian peoples.” Nothingis more self-delegitimizing and counter-productive to achieving peace based on Arab recognition of Jews’ right to be there, than that Jews should go around calling Palestinian Arabs “ThePalestinians.” They have no distinguishing language, religion, or culture from neighboring Arabs, and have never been sovereign in Palestine, whereas the Jews, with a presence stretching back three millennia, have had three states there, all Jerusalem-based. Most Palestinian Arabs cannot trace their own lineage to the land back more than 4 generations.

Israel's history suggests a key to peace is a swift end to its aberrant two-state solution and the adoption of the suitable alternative. In proposing such I do not suggest one can trace a biblical lineage to non-Jewish occupiers living between the Jordan River and Mediterranean Sea, rather a behavioral linkage to the present sorry state of Israel’s Jewish sovereignty.
Avraham’s monotheism unified his mission spiritually and practically. On arrival in the parched land God promised him and his descendants, he could clearly see there was work to do and when he encountered Noah’s son Shem or Melchizedek, he revived knowledge of his cultural descendant's. But, he did not stay in the land, he traveled further south to Egypt where he negotiated Shem’s territorial rights with Shem’s brother, Egypt’s first pharaoh Khem/Cham or Ham. Hagar, Cham’s daughter was provided to Avraham as pharaoh’s collateral an acknowledgment of Shem’s plea. On Avraham’s return to his promised land, he struck a treaty with Cham’s descendant Avi Melech - The Father King. The two-state deal precluded Avraham banishing Avi Melech’s living relatives from Azah (Gaza), Hevron (in the West Bank) and Salem (Jerusalem).
After Yitzchak was born to Avraham and Sarah, Sarah’s patience with Hagar, pharaoh’s collateral came to an abrupt end, she kicked her and son Ishmael (to Avraham) out of her camp. While Avraham was prepared to negotiate, a political and diplomatic treaty using the land God promised, Sarah was not., she had no intention of complicating Yitzchak’s right of inheritance any further than Avraham had already done. After Sarah passed away (aged 127) during the moments Avraham offered his son as a sacrifice (Akeidat Yitzchak) at Mount Moriah, he traveled back to Hevron where he negotiated to buy the plot at Machpela where she was buried. Then Avraham turned his attention to marrying Yitzchak, making sure his future wife came from the lineage of Sarah’s family. Yitzchak married Rivka who filled the tent of her mother in law while he played double down diplomacy, politically extending his fathers two-state covenant of peace to Avi Melech's future descendants.
Rivkah bore son’s Yaakov and Eisav and struggled hard to maintain and establish Sarah’s progeny. On Yaakov’s return from the land of Sarah’s family, where he married his wives and established his family and fortune, he first traveled back to Mount Moriah. At the site of Akeidat Yitzchak he began to execute a previous covenant he made at the same site. Before he left the Promised Land he promised - “The stone which I have set as a covenant will be the House of God.” While attempting to build the House of God, Rivkah passed away, Yaakov abruptly left the site to bury his mother in Hevron, she was 127 years old. Tragically, on the way his first love, wife, Rachel passed away during the birth of their 13th child Binyamin. Years later the family were exiled to Egypt from their home in Shechem (Nablus).
Because of Avraham and Yitzchak’s aberrant two-state covenants on the land, Yaakov’s promise and covenant is yet to be fulfilled. Two previous House of God attempts to build and maintain temples at Temple Mount, the worlds most contested real-estate failed. Finally we live in the generations that are capable of realizing Yaakov’s dream, however Jewish self inflicted struggle over Sarah’s sovereign view must be rectified. Although Avraham merited a child only because he compassionately prayed that Avi Melech have a child, Jews must not fall victim to the heady Utopian passions of Avraham and Yitzchak. Instead they must follow the doggedly, determined, materialistic visions of Sarah and Rivkah. If Abraham had simply stayed in the land, things would have been different!
The Hebrew year 5800 is 25 years ahead, this is the right time to realize Yaakov’s vision. I hold a view that the worlds most hotly contested real-estate may yet hold some surprises, that the first two temples were built in the wrong places, higher up the mountain, but the right place is on its neck. However, the focus for now is Sarah’s sovereign view, whether Jews sell out or stick to her program depends on their constant mindfulness. Jerusalem 5800 proposes and demands It become a World City, one that has been planned during the past four years by more than 40 consultants. Its more than 400 pages are built on the foundation of the Israeli and City government and the bureaucracy’s existing plans.
In the lead up to Israel's next election, the 5800 plan will inspire serious questions about a divided or united Jerusalem by which politicians will be blessed or plagued. But, building the city is part plan that cannot happen until the mental adjustment over Jewish sovereignty is made. Ask yourself whether you are ready to uphold mother Sarahs’ sovereign view and what is the modern context? A modern Jewish nation cannot condone a land that divides people and denies them reasonable representation, but two-states is still being used to divert Jews and those persuaded by aberrant covenants. Meanwhile poverty in Jerusalem is running at 37% while benefactors feed social injustices for the benefit of their brand insurgency. Economic prosperity is Israel’s most advanced anti-terror weapon, but unskilled labor supply remains low and must be accelerated. To rebuild we must be serious about the financial sustainability that ancient Jewish culture provides to industries like tourism.
Democracy is no friend of Jewish sovereignty especially if Israel extends citizenship to all non-Jews living West of the Jordan River. Therefore, it must ensure its Jewish sovereign future ultimately modifying its government structure before it provides all people resident alien status, a path to citizenship and the vote. The 70 elders that once represented the Jewish community prevailed over a hierarchy of community captains of 1000’s, 100’s, 50’s and 10’s. Israel’s national government still incorporates some equivalence to this framework found in the in elected City Rabbi’s that obtain their status through community synagogues and Mayors of cities nationwide. I believe this framework can eventually be elevated by a national referendum to establish a bicameral parliamentary equivalent, Israel’s future senate. At such time in the future a senate of elected Rabbi’s can represent Israel’s community interest by approving the law’s of the country. Once authoritative, they can also obtain the mantle to modify and converge Talmudic law to develop it consistently with Israel’s state law so that only one body of law eventually governs all citizens of the nation.
As the world around Israel implodes Jews must remain focused on Sarah’s vision, she had it right, only one owner, one land. Through her, Rivkah and Jacob’s wives Leah and Rachel, Israel's Jews remain grounded to achieve their collective destiny. Each must find a way to participate, get involved, sharpen and strengthen their views for the home stretch. One way to do that is to sign up at Jerusalem5800 on Facebook or theweb.
